    22 to 25 months???

Whenever I'm near the processing time..its always increased..20th month going to finish nd again processing time increased..its like a hell..waiting Offshore..

It's really disappointing as this is not making any sense.. Soon we will reach 3 years of processing time before any visa gets approved..

I am really over this shit!

Is it a bad thing for one to call or email immigration about the status of their application, mine is just approximately 11 months now.

    Hi mate,

There is no such thing as bad to follow up on your visa application over the phone or by email but just bear in mind that you might not get any relevant info on the progress of your application..

I am just talking out of experience but maybe you will be more lucky than me if you try who knows..

Good luck anyway! Give us some good news.

    I have a question,

I am from Hong Kong, which is a LR country. However my husband is from China. Will my case be considered low risk or high risk country?

    Hi mate,

I did not know that one's nationality can whether be a bonus or a setback..

I have seen people saying not only that the country where you come from can be a factor (LR or HR), but the position you are sponsored under can have priority over other positions.

Would you please be able to provide more info on the above? Please share with us as I would like to check if my country is considered as LR and if my position has priority too.

    Thanks heaps.

So worried According to the latest results I think they are only approving 10 out of 100 visa application for 187visa. Waheguru g mehar karn sareya ta.

No mate. There is 50% of all applications being rejected atm. And we cant blame the gov as they are trying to keep only genuine applications and in other words, protect their great country.. People have abused of the system and have done heaps of shit to cut corners.. so i dont blame the gov, but its just unfair on the people who have done it the right way... I must agree..

Hi everyone, sorry to spread the bad news but my nomination got refused yesterday with the reason being “ no genuine need”.

    applied 13/12/16

    refused 6/8/18

    office manager

    QLD

All the financial documents and full time work pay slips were up-to-date but case officer rejected it straight away without asking anything.

Never been this sad in my life ?.

Sorry to hear that! Hope that you can prove that there is a genuine need somehow, dont let it bring you down, and check your options (especially if you have done it the right way and it is genuine indeed)

    Best of luck!

My worry is will my Visa get denied on the basis my employer isn't giving me the hours I need, or was promised, for it?? Although there is the work here, they're just giving a new employee more hours on the basis of me eventually going on maternity leave.

I have been working for my employer for 2 years next month, I don't know how much more I can take but will not leave because I want my Visa so badly!

I understand your worry and to be honest it will be better to show to Immi that you are full time as of now but if you cant get it, remember that it is not an obligation while on bridging visa. Stay positive, he has signed your visa form on your application in which your employer has committed to give you work as a full time person for 2 years.. so dont worry for now, the commitment starts after visa is being granted.. and that will be on him not on you, as you are doing things clearly the right way here.. and am sure thats something you can justify as you are pregnant and maybe there is only so much you can handle at the moment.. (you could still argue that your employer has brought a person to replace during the maternity leave)

Hang on girl! You are almost there!

Immi will be processing 2017 files very soon am sure ??

    Thank you mate, appreciate it!

Every time I speak with my MA, I get more and more confused about the 187 obligations, restrictions etc! Perhaps I will email again and ask what hours I am meant to be getting because last time I was told that while the Visa is processing, I don't technically even have to work for my employer! All these technicalities are confusing!

I have emailed fair work too, I will keep you all updated with what I find out, in case anyone is in a similar situation.

    Hi Hayley,

No worries! Below are my advice to you:

    - You arent in the obligation to start work while on your bridging visa but note that if you dont, immigration may be wondering " that your company dont really need you"

    - My advice is to work full time before visa granted to make sure you can get it, and if after visa granted the employer is still not giving you enough hours (though you should push for being full time), then thats his issues not yours, as he isnt fulfilling his commitments.

    - Dont get in touch as of yet with fair work if your visa hasnt been granted yet, as immigration says that "you have the option to withdraw your application"...

I dont know much about legal advice for 187 but I know we have some rights and if you are facing some discrimination, Fair Work should be your first call!

Does anyone know who is best to speak to, in terms of our rights? After almost 2 years working with my employer, my hours may be getting cut again and another employee has been given more hours and a pay rise after only being here for 6 months. This was also done on the basis I will be going on maternity leave in 5 months. Do I have any leg to stand on or is it the same as usual, we just shut up and take it?!

I thought we were meant to be treated as equal to an Aussie employee, let alone that I'm sure I can't be discriminated against because I'm pregnant? I'm at my wits end with all this. Working my ass off for 2 years and paying all this for a Visa when I'm treated like half a worker.

    Hi Hayley,

There is the fair work you can speak to, but before you do so, you will be best to speak to a migration solicitor at first as they can give you professional advice on what to do or not and make sure your visa isnt at risk.

Stay strong and think of the beautiful future you will give to your baby!

I have contacted the Immi dept today asking for the above info. They replied that the 2 years start from when the applicant commence to work full time for the visa purposes and not from when the 187 visa is granted. The reason is because in the past the 187 visa took between 6 and 8 months to be granted.

    Cheers

    Hi there,

That sounds like a great news.

Not that I am not believing you, but this has been so  controversial and everyone is saying something different. Could you please advise where can we find this info on the immi website?

    Cheers

  10. The NTCC came into effect in March 2018 to replace the Training benchmark. The training benchmark applies to the followig visas: old 457; 186 ; 187 (TTS) but not the 187 (direct entry)..

So basically if you applied for a 187 (DE) before the changes in March 2018 your employer isnt forced to prove the training expenses he made on his Australians and PR workers.

Thats my understanding of it but I can be wrong after all.

    Hope it makes sense.

As I spoke to immigration last week. A guy said most of the cases open in 12 months of time like a Nomination. 75% cases , 15% cases takes little long and 10% cases are taking too long. It depends upon your application and your occupation. I hope that it might help you guysemoji4.pngemoji4.pngemoji4.png

    Hi fellow mate,

Are you saying that 75% of the applications are openened within 12 months? Do you mean visa + nomination if applied together?

I dont know if you have looked at the processing times but it says 21-24 months.. so there is still a chance that  good percentage of apps get processed out of the processing times?

Can you please explain how it can depend on your position? Does that mean some position are processed before others?

Were can I check if my position has priority over other positions or less priority?

Anyone that has any extra info on the matter please kindly advise.

    Many thanks

  12. Congrats lalaus! May we get some other good news and get done with 2016 applications.. for god sake ?

they are definitely working backwards, by month dec - jan 2016, then prob Dec -  jan 17, then work forward from ?, assuming  change of rules brought in lesser applications ?

Am not too sure this is the case.. from what evidence are you stating this?
