  3. Hey guys, 

    what about if during the 2 years under sponsor, the company changed the director without saying nothing to the immigration? The company chart and my position has been the same, also ABN didn’t change. So everything is  like when I applied except for the director from daughter to her mum. It’s a family business.

    I know that they should tell them within 28 days, but the company didn’t know it. 

    What I can do? My MA said to leave like this because it’s not something that could cancel my visa because the business is the same. My MA said that maybe they can ask why the company didn’t report it to the immigration and at the point, he said (MA) we can send other documents that will proof that everything is the same as before that I applied.

    No mate. It doesn’t mean that is a good sign. Many people here have to the CO additional documents. 

    Can you say what your job, when you applied and so on, please.

    - I do however, think it's wise and advisable that your accountant wrote that letter.
    Although some people may have a different opinion, I feel that, the more information - the better.
    Just in case the CO does question it, the document supporting it, would be there, ready for them to read through. 

    As for your PCC, as I say - this is entirely up to you. Worst case (regarding the PCC only), is that they ask for another and you have to wait 'x' weeks for them to respond after. 

    Can the CO refuse an application due to the PCC expired?

    So, it looks like it could even be only valid for 6 months 🙂 

    Regardless, I'd confirm the length of validity and act accordingly. 

     

    It makes sense, but there is nothing write on he document so they should google! 😂😂😂

    Anyway it is not a big problem, I’ll ask my MA what to do. I think that to wait another 1-2 months is better also because I will go on holiday in Italy so I’ll be able to do it by myself and send it through email to my MA. 

    Anyway at the moment I’m focusing in another thing. immi is refusing a lot of applications because no much profit in the company. 2 years ago my company closed another and for them 2016 has been closed with a lot of loss. But the year after they closed  with some profit. So my MA contacted the Accountant of the company and said to write a letter explaining why there were no profit in 2016. In addition, the accountant wrote the plan how the company is handling it and what they are doing now and in the future to improve again the profit as the last 20 years. By the way, the business has been opened since 20 years more or less. 

    Do you think it can be a problem about the 2016 loss?

    Has been smart to write a letter by the accountant explaining why it happened?

    As for re-doing it. With your timeline, I would risk waiting 1-2 months after the 12 month window, then get it re-done. 
    - It also depends on if you're willing to wait. Worst case, after 12 months the CO could ask for you to redo it, prolonging your case. If you don't want to risk that, then have it done sooner.

    Many people told me that the police check is for 1 year and there is write in the document “valid for one year”. 

    However, I am from Italy and on our police check there is the date that has been done but there isn’t anything saying “valid only for one year”.

    So, even if there isn’t anything say “valid only for one year” I should send a new one to the immigration? Or is it a one year valid only if the document report it? Or it’s an Australian law that all these kind of documents are valid only for one year?

    Normally police check is valid for 1 year, depending of the country, ok. But 1 year start from the day that we apply or from the day that the documents has been done?

    I did my police check in November 2017 and I applied April 2018. 

    Should I do it again and send to the immigration?

    The decision to refuse nomination was overturned and my Visa was granted today 🍾

    Put it this way, my MA agent was unbelievable and I owe them so much.

    Its crazy, I've went to feeling so down to so high in a matter of weeks.

    I will post again soon detailing the whole timeline and what exactly happened....for now, I'm going to celebrate 🎉

  12. Guys a have one million question:

    why there are same application that takes 2 months to be approved and others that after 2 years are still waiting? Sometimes we are talking about the same position but for instance different companies. 

     

    I have ave my personal idea but tell me if I’m wrong and if someone else has a different opinion, please.

    I think that it depends of the Migration Agency. If the MA is a famous, important and well known the application can be easily approved in a very short time. But, if the MA is not important and so on the application could take up to 2 years.

    What do you think? Am I right?

    Before anything, you would need the company nomination approved, I'm assuming they have sponsored others before?

    But I've also seen a few cases on here, where people were waiting nearly 2 years. 

    I believe there is a few factors; 

    • Size of the business, have they sponsored someone before. Small businesses with low revenue / staff generally get looked at in greater detail. A lot of Hairdressers I assume work for smaller salons. 
    • Hair Dresser is a ANZCO Level 3 Skill Job, and so the qualifications required to meet the Skill level e.g. a AQF Certificate / equivalent, which is available at college level may come from a bogus institute (more common than you think). Not to mention there is many variations of AQF Certificates, depending on which country you obtained the certification in.  In comparison to a ANZCO Level 1 - where you need a Bachelor Degree, and so the Institute is generally more well known / more clear cut. Thus, further investigation into the college / qualifications might be necessary, especially if from a HR country. 

    Many other factors come into play also, but these are two that stand out for me. 

    As you are TRT, and so have already had your 457 approved, this should help, as they've already approved you for that role, rather than a DE applicant.

    Yes, I come from a 457, so they already looked all the documents before they approved my sponsorship. In addition, the business where I’m working, it’s not very big, but it has been opened since 20 years already. So, this should help immigration to understand that is a solid business. 

    Am I right?

    Haven't seen too many April applications be processed as of yet. But in your case, as a Hair Dresser, you might have to wait a little longer, as this occupation is often scrutinized more than others. 

    Why Hairdressers are scrutinised more than others?

    That is not accurate - CO's will (should) only request a police check on 2 cases:
    1. There isn't a police clearance provided on the application. 
    2. The police clearance provided has expired and they need it renewed. 

    The department will look at all aspects of the application / applicant, including your super / tax details. 

    How long the Police check is valid?

  17. So guys, from what I can see many CO are asking police check, and it doesn’t matter when has been done it, they are asking even if it has been done less than 8 months.

    am I correct? 

    Another question: anyone knows if the immi now is connected with ATO? I heard that they are looking for SUPERANNUATION paid by employees.

    5/03/2019 - both visa granted. 

    Its been a long waiting but it is worth to wait. So happy guys.
