blossom
Does it matter? If it's cancelled it's cancelled.
wrussell
I was wondering if the Department had grounds for cancellation under BOTH 109 for incorrect information and 501 for character which power would they use and why? Cheers Kane The DIBP (then DIAC) when overruled by the MRT has been known to use different grounds to dispose of an unwanted applicant. Those who cop it from ASIO or for a substantial criminal record (s501) face a lifetime exclusion (non return) period. Those who cop it for fraudulent documents or false/misleading claims (in most cases) face a 3-year exclusion period and would not have enhanced their future visa prospects. Using the information above you should be able to answer your own question.
