Lee Arvin
Dear All, I would like to ask for help if someone have the same case as ours. I have applied for subclass 190 (Nominated by State) but the Immigration came back to us stating that my son did not meet the health requirement because of Autism Spectrum Disorder. We have given us 28 days to comment before they will decide the verdict. I will appreciate any help from you all. Best Regards, Lee
VERYSTORMY
You need to speak to a specialist migration agent urgently. George Lombard is a well known expert in visas with medical complications. The department look at what costs any health issue will cost
Quoll
The usual recommendation if you have a family member with a disability is to talk to one of the agents who specialise in such things - George Lombard and Peter Bollard are the two usually suggested. There is a real Catch 22 with things like Autism - if a child is deemed needy enough to be eligible for any support in schools then you are likely to be rejected for a visa. If they give you a visa then the child is unlikely to get any support in school. So if your child is currently receiving substantial support in school you are not likely to succeed. If you believe your child is/will be independent in school then you could submit a full assessment covering cognitive ability, skill level and adaptive behaviour as assessed by their current placement.

The letter even states that I have no merit to appeal which clearly shows strong indication of no chance getting approved. We are currently applying for Canada as they have lifted this policy of getting rejected due to child with autism.

Lee Arvin
Hi Ali, As what I have said my case has no merit to appeal. We just moved on and accepted their decision.
BobHatton
Just tell them that your child DOESN'T actually have Autism; as is the case in 98% of over-diagnosed children!

It is already late to say that, and the letter states that no merit to appeal. By the way it is the Physician who have diagnosed my son as we would not like to let them know. This made me realized how corrupt the world is, rejecting someone who has this condition has nothing but cold heart forged in the cave of inhuman policies. What a shame. Lying to immigration and on a forum that immigration visit - isn't the wisest choice I would imagine.
BobHatton
It was meant purely tongue in cheek Ali...
