So will they contact us about checking the medicals again? Last time we went the doctor said nothing has changed and unless there are symptoms, we leave it at that... Not sure what that meant.

Hi all, hopefully there's some good news around the corner for a few of us! Just a quick question, my police check is about to expire. I just wanted to confirm if it expires exactly 12 months to the date or 1 day before the 12 month mark. So for a police check for example 22nd April 2022, does it expire today (21st April 2023) or tomorrow (22nd April 2023).

Congratulations! Also, NOT FAIR 🙂 We've been waiting 13 months already for our 100 VISA. I guess they don't care about the 100s that much, as the 309 is actually Indefinite... So yeah. Even banks treat the 309 and the 100 as the same thing.

Thank you! I was a bit shocked how quickly they granted. 
I hope your 100 comes through quickly! 🤞🏽 that’s good to know that they treat 309 as indefinite. 
I have gone through both British and Australian spouse visa routes now, have to say the Australian system is much better, and cost less overall!

If you have been granted your 100 at the same time as your 309 then you've been granted permanent residency anyways!

Hello everyone 🙂

I am hoping someone could please help regarding the Partner Visa 309/100. I am currently on the Partner Visa 309 and I have now been invited to submit my evidence for the 100. 

I have a tonne of evidence from the last 2 years (mortgage documents, engagement, travel documents, joint bank accounts, joint photos, joint social media posts, a brief statement/update for our case officer, form 888's etc) however I just wondered about the police checks and some other bits. 

1) 309 was granted 4th April 2022 and we moved to Australia in February 2023. Do I need another UK police check even though I was only in the UK for 11 months prior to moving to Australia? I'm wondering if I would be best getting one to save any delays. 

2) I have my AFP police check, does my sponsor need this too? 

3) Do I need to complete a Form 929 even though I updated our address via Immi? 

4) We are planning to get married late October 2025 - will this affect our visa if it is still processing? Or would we simply let Immi know? 

5) Is there a checklist for evidence requirements anywhere? I've been following the Step by Step on Immi (which I done for the 309) but I'm just looking to double check in case there is anything I have missed!

We had double grant 309/100 today. Applied in UK but appears approval was processed from Berlin embassy. Timeline was:

12 Feb 24 - application submitted

19 apr 24 - RFI for applicant to get AFP police check

03 jul 24 - RFI for sponsor to get AFP police check

09 jul 24 - double grant 309/100

sponsor - aussie

applicant - british

1 dual citizen child together. 
 

We didn’t front load the afp police checks as didn’t think they would be needed as I’ve not lived in Aus for 20 years and my partner has never lived there but they seemed to be needed for the grant of the 100.

Hi all, I have also had a recent 309/100 double grant from the UK (January 2024 submitted > May police/health checks > July granted)

For the two certificates received via IMMI, the 309 says: first entry within 12 months and the 100 says: first entry within 5 years

Can someone please help me clarify what must be followed under the double grant situation:

  1. enter within 12 months: "activate" the 309, which then immediately "activates" the 100
  2. enter within 12 months on 309, then assume within the next 5 years leave and enter again to activate the 100
  3. 309 entry rules are now irrelvant; so long as I enter within 5 years the 100 will be successfully activated

Thanks in advance and apologies if this is stating the obvious - just finding it hard on the IMMI website to find explicit explanations around the situation regarding a double grant.

Bit unusual to have a First Entry date of Five Years - are you sure it doesn't say "Must not enter after 'five years' "? , and 

The usual wording of a grant would be something like "Must make first entry by 15/08/2025 and must not enter after 15/08/2029"

The 309 has been replaced by the 100, so is irrelevant. There will be a “first entry by” date on the 100 grant letter - you need to make a first entry by that date, which is almost certainly 12 months from the grant date. The visa’s final expiry will be after 5 years.

Latest partner visa processing time update: subclass 309/100 lodged for UK based applicant client of ours on 24 June 2024.

The 309 and then the 100 permanent residency visas were granted on 9 August 2024 = just under 7 weeks from lodgement to grant.

Thanks. My surprise is that the first entry date on the 100 grant is not in one year's time, but in 5 years time. All the advice I've seen is that the "for first entry, arrive by" date between the 309 and 100 will correspond and be 12 months, which isn't the case with mine. 

The timings on both are pasted below. I'm assuming I have 5 years from now to enter?

Have you checked MyVevo? It also gives your Enter before date on there.
