Dristi
Questions Hi, I am applying for 187 DE. RCB is approved. Nomination applied on March 2019. Now I was about to apply for visa but we had one problem that my husband had some case in overseas where he stayed for 4 years. We applied for police clearance but it gets refused. He applied for visa to go there and sort out as he said that is the small case and he thought it was dismissed already. Now I am worried if I should apply this visa or not. If I apply I know we have to submit police clearance from all the countries where we have been for more than a year in last 10 years. I am main applicant and he is dependent, we have police clearance from our home country and Australia but just not from that country where he lived for 4 years in last 10 years. Is there any way we can get away from this? Or since I included him in my nomination, can I now not include him in visa? Help will be appreciated. Thanks

VERYSTORMY
Hi will need some sort of police / criminal record check. Even if it is saying he has an offence. Having a criminal offence is not a total bar on the visa. It would depend on the offence and the sentence given.

Do you mean that the Police clearance shows a conviction? You cannot avoid providing a Police clearance unless you can show evidence that it is not possible to obtain one from that country.
