Which parent visa??

Hi all,

 

We are moving to Melbourne in July/August time on a 4 year 457 visa. We are aware that after 2 years we can apply for permanent residency.

 

My parents want to move out in 2-3 years, does anyone know if you can start their visa process now or do we have to wait until we get permanent residency?

 

Does anyone have experience of applying for PR from a 457 visa whilst living in Australia? How long does it roughly take?

Your parents can't apply until they meet the criteria, so they must pass balance of family test and have son/daughter who is PR and settled in Australia (settled usually means being there for 2 years but it can be less).

 

Are they aware of the cost associated with contributory parent visa? The non-contributory one takes 10 years + to get.

Also you need to plan your route to PR. It is not automatic to progress to PR after 2 years, your employer needs to sponsor you for this - and they can do this at any time from day one (just that after 2 years you won't need a skills assessment).

 

If your employer won't sponsor you then you would have to apply for skilled independent visa.

Your parents cannot apply for a Parent visa until you have PR and are 'settled' in Australia.

 

Are you aware though that obtaining PR from a 457 is in no way automatic? Many people think that it is which is incorrect as you only get PR if you are sponsored for and are granted a permanent visa.

 

Your 457 employer must be willing to sponsor you for (usually) an 856 ENS visa and must of course be willing to meet all of the conditions of that sponsorship. If your employer is willing to sponsor you for an 856 and if you get skills assessment, you can apply for the 856 at any time - there is no 2 year requirement. That only applies if you wish or need to skip the skills assessment requirement.

At present, ENS visas seem to be taking at least 6 months from the date of application. The following very long thread is all about the timeline for ENS visas:

If the work is in a designated regional area, an RSMS visa is another possibility for PR but you must still be sponsored for it by a willing and eligible employer.

Thanks for your replies, this helps a lot. In no way did I think that 457 to PR was automatic! I just wondered if anyone knew how long it can take? My OH is being sponsored through his company for the 457 at the moment so hoping that they will assist with PR after 2 years.

 

Yes am aware of the contributory visa, this is not a problem which is good, I did think that they would have to wait until we are permanent residents but just wondered if there was a starting process but I guess they need points too?
