Partner visa 820 temp to 801 permanent - when will immi contact?

Hi

 

I just wanted to check if anyone else has been recently applied/been granted for the permanent spouse visa 801, following been on the 820 temporary spouse visa.

 

I rang immigration this week and they said that they will contact no sooner than the 2 year mark or anytime up to a month after. Is this the usual thing they say even though I have heard many people receive letters from immigration 2 months before the 2 year mark to request an update on the situation and to apply for PR?

I received info from them last week, more police checks grrrr. I applied initially early sept 09. They have your correct address? That said they may ignore that anyway as they sent my stuff to my MIL in Aus when I'd told them we were still in the UK till Sept!

IMMI are supposed to send paperwork a few months before the 2 years are up but they never did in my case even though they said they did and they had the correct address. After 4 requests they finally sent it and I managed to get everything done in time. My advice is to contact them 2 months before to get them to send it and phone every few days until they do and make sure you have all of the information they will need in advance so you can do it quickly. Don't send off for the police check until you get the paperwork though.

 

Most of the forms were the same as for the first stage so if you have photocopies of that you should have most of it. I think I had to have all of the details of passports, where I;d been abroad for the last 10 years, jobs (should be on your CV anyway). I didnt need to prove we were still in a relationship (rent agreements, bank statements etc but make sure you have them all just in case.

I am due my 801 visa in a few months , I rang IMMI to see when it was due as I want to apply to uni and was told that the 2 year anniversary flashes up on their computer and they post it on the day...but like you said people have had it several months before. I do keep checking my mailbox in hope even though its not due till December lol. Good luck!!

It also says on my temporary paper visa to contact 2 months before hand to see what you need for the second stage...maybe try your luck

Hey

Im in the same boat, just to clear up a point im unsure on, is the 2 years form when you applied for the visa (so june 2010 in my case) or when it was issued Oct 2010 or when i entered Oz March 11 ? Reading my paperwork it says from when you applied.

Shame i didnt photocopy my first application would save me loads of time filling the same forms out again plus i havent got my old passorts or any idea where ive been or the dates in the last 10 years, nightmare ! Im worried that it wont tally with my last application i sent in. If id known it was the same forms again id have kept a copy, but the form reads like you have done that stage and it automatically applies for the second stage and you dont have to go through all the same stuff again. Luckily i never stopped collecting evidence .

Lol, we used to do photos 'for immigration purposes' when we had friends around, parties, holidays etc where we pull funny faces, cheesy grins or 'porn poses'. I was looking forward to sending them as they were very funny but Immigration never asked for photos.

Thanks Bogan Bear. Yep I will contact them in a couple of weeks when it is the 2 months prior mark. I have started to arrange some of the checks - the medical I have in just over a weeks time and I have sent off my police check (the lady at immi said it would be ok for me to get things together if I want as they are valid for 12 months.) What was your reason that it is best to wait until you receive the letter before you do the police check?

I am, still here for another 6 weeks. But I wouldn't get medicals until you know they want them. I haven't been asked for them and I've got a medical condition which meant HOC wanted consultant reports & it took forever for them to grant my 309. Yet not been asked for medicals for this stage! And according to the letter from them the second stage will take min of 8 months, so police checks may not be wise until you're asked for them!

I got my letter from immigration yesterday to put forward my application for 801 spouse, permanent residency - just over 2 months before the 2 year mark.

 

I am going to hand mine in with all the necessary documents as soon as I can but I have no idea how long it will take before they contact me regarding getting PR. Immigration say it could be a maximum of 6 - 8 months but here's hoping it will be much quicker than this.

 

Will keep you all up to date on progress...

This is alarming. I did police checks and medicals for my fiance visa and got the 820 application in before they expired. The wording of the 820 suggested that the conversion was automatic and implied that no further paperwork would be required. Does this mean I will have to redo police checks and medicals when the 820 is converted to an 801? And if so, what happend if I fail the medical?

Proudpom, it's just an australian police check they ask for, along with (I think I remember correctly from another thread) a form to fill out and you and partner need to submit stat dec that you are still together, and provide contact details for a couple of friend/family referees.
